Terms of service

Terms of service

1. Applicability

  1. In these Terms and Conditions, the following definitions apply:

  • 'Buyer': Any natural or legal person who has or enters into a contractual relationship of any kind with Justpadel.com.

  • 'Consumer Buyer': Any natural person not acting in the exercise of a profession or business who has or enters into a contractual relationship of any kind with Justpadel.com.

  • 'Products': The subject of one or more agreements.

  1. These Terms and Conditions apply to all offers made by Justpadel.com and all agreements concluded with Justpadel.com.

  2. In addition to these Terms and Conditions, additional terms may apply to certain services and/or products, if explicitly indicated. In case of any differences, the provisions in the Additional Terms shall prevail over these General Terms and Conditions, unless otherwise specified.

  3. Deviations from one or more provisions of these Terms and Conditions shall only be valid if explicitly agreed in writing. The remaining provisions will remain fully applicable.

  4. Terms and conditions used by the Buyer are not applicable unless explicitly accepted in writing by Justpadel.com.

  5. The websites of Justpadel.com are aimed exclusively at the Dutch and Belgian markets.

  6. Justpadel.com reserves the right to change and/or supplement the Terms and Conditions.

  7. By using the websites of Justpadel.com and/or placing an order, the Buyer accepts these Terms and Conditions, as well as all other rights and obligations stated on the website.

  8. Justpadel.com is entitled to use third parties for the execution of an agreement with the Buyer.

2. Offers and Formation of Agreements

  1. Offers or quotations should be seen as an invitation to potential Buyers to make an offer. Justpadel.com is in no way bound unless explicitly stated in writing. Acceptance of the invitation by the potential Buyer counts as an offer and only leads to a binding agreement if the other conditions in this article are met.

  2. Offers are valid as long as stocks last.

  3. A personalised quotation is valid for two (2) weeks unless another term is specified in the quotation.

  4. An offer by a potential Buyer is deemed made in the following circumstances:

  • the potential Buyer has entered the necessary data into the appropriate form on the website and this has been electronically submitted to and received by Justpadel.com;

  • the potential Buyer has explicitly indicated during a visit to a Justpadel.com location the desire to purchase or receive a specific product or service;

  • the potential Buyer has explicitly expressed the desire to receive a product or service by phone;

  • the Buyer has signed and returned a personalised quotation issued by Justpadel.com.

  1. An agreement is concluded at the moment the Buyer receives an order confirmation, or when the offer has been made through the website, when the order confirmation is sent by email to the address provided by the Buyer. Justpadel.com may revoke the agreement if the Buyer fails to meet or previously failed to meet the conditions. Justpadel.com will inform the Buyer within ten (10) days of receiving the order.

  2. Buyer and Justpadel.com expressly agree that a valid agreement is concluded using electronic communication, as long as the conditions in 2.4 and 2.5 are met. In particular, the absence of a traditional signature does not affect the binding nature of the offer and its acceptance. The electronic records of Justpadel.com serve, as far as permitted by law, as presumptive evidence.

  3. Information, images, oral communications, quotations, etc. concerning all offers and the main characteristics of the products provided by phone or email are as accurate as possible. However, Justpadel.com does not guarantee that all offers and products will completely match the information provided. Variations do not entitle the Buyer to compensation or termination.

  4. If Justpadel.com cannot meet the delivery deadline of 30 days, the Buyer has the right to terminate the agreement. The Buyer must contact Justpadel.com for this purpose.

3. Prices

  1. All prices are stated in Euros and include VAT, in accordance with legal requirements.

  2. Special offers are valid as long as stocks last.

  3. The Buyer owes the price that Justpadel.com has confirmed according to Article 2.5. Obvious errors in the price, such as clear inaccuracies, may be corrected even after the agreement has been concluded.

  4. Delivery costs are not included in the price and are clearly stated during checkout before the order is completed. Special rates apply for deliveries outside the Netherlands and Belgium. Certain payment methods may have specific terms and related costs, which will be clearly communicated to the Buyer.

  5. If product or service prices increase between the order and its fulfilment, the Buyer may cancel the order or dissolve the agreement within ten (10) days after notification of the price increase.

4. Payment

  1. Orders placed via the website can be paid using:

  • Prepayment

  • Credit Card (VISA, Mastercard)

  • iDeal

  • PayPal

  • Bancontact

  • Apple Pay

  • Google Pay

Justpadel.com may extend payment options in the future. Any additions will be announced on the website.

  1. Payment methods can only be used if the associated conditions – including checks on creditworthiness, authentication, and authorisation – are met.

  2. If a payment term has been agreed upon, the Buyer is in default once that period has expired. Payment terms may only be agreed in writing under conditions to be set at that time.

  3. If payment is made via credit card, the terms of the card issuer apply. Justpadel.com is not a party to the relationship between the Buyer and the card issuer.

  4. In the event of late or non-payment, the Buyer owes 1.44% interest per month on the outstanding amount, calculated from the due date until full payment is made. Any part of a month counts as a full month.

  5. All (extra)judicial costs incurred by Justpadel.com due to the Buyer's failure to meet obligations are at the Buyer's expense.
